Topeka’s governing body voted unanimously Saturday morning to deny business owner Chris Schultz’s claim seeking $116,000 in damages related to water damage to buildings he owns at 909 and 911 S. Kansas Ave.
The council, which made the decision following a 40-minutes executive session, characterized the decision as significant and serious.
“My issue with this claim is the process,” Deputy Mayor Brendan Jensen said. “I’m just simply not equipped to make this decision. I don’t have the resources and the tools. We’re just not set up to do that. So, I’m going to vote to deny this, but not because I don’t feel strongly that there could be a problem there. Clearly, there’s water.”
Mayor Michelle De La Isla added, “We are very concerned. We want to be good neighbors. But as part of being good neighbors, this is not a judicial system.”
